In short: you own your content; you pay monthly and can cancel any time, keeping the service to the end of the paid month; we watch, back up and protect your hosting but don't guarantee uptime unless a signed agreement does; keep your own copies; Nevada law applies. The full terms below are what count.
1. Who these terms are between
These terms are an agreement between SecureGate Technologies LLC, a Nevada limited liability company doing business as SecureGate, based in Reno, Nevada ("SecureGate", "we", "us"), and the business that uses our website, customer hub or online services ("you"). The person who creates an account confirms they're at least 18 and authorized to accept these terms for their business.
They cover the customer hub (securegatetechnologies.com/hub) and the services you buy in it: website hosting, app hosting, virtual drives and accounting software. Custom software, app and website projects are governed by a separate signed agreement, such as our Master Services Agreement and a Statement of Work. If a signed agreement and these terms conflict, the signed agreement controls for that work.
Our services are for businesses. They aren't intended for personal, family or household use.
2. Your account
- Give accurate details and keep your email address current; we use it for receipts, security alerts and outage notices.
- Every account uses two-factor sign-in. Keep your password, authenticator and recovery codes private; you're responsible for what happens under your account until you tell us it's been compromised.
- Owners of a business in the hub can invite people, buy and cancel services, and see billing. You're responsible for the people you add and for removing those who should no longer have access.
- You need to confirm your email address before buying or inviting people.
3. What each service includes
We describe what's included in the store and on each product's page. As of the date above:
- Website hosting: one website of static files (HTML, CSS, JavaScript, images), uploaded over SFTP; HTTPS certificates; up to 5 GB and 200,000 files; nightly backups kept for 14 days; uptime checks every 5 minutes with email alerts; nightly malware scans; a web application firewall. Server-side code such as PHP or WordPress isn't included unless your plan says so.
- App hosting: one app in its own container on our app server, updates that go live when you approve them, health checks with automatic rollback, uptime checks, nightly malware scans of the app's code, and the firewall. The details of each app (domains, data, backups) are agreed with you when we set it up.
- Virtual drives: storage of the size you choose, shown as a drive letter in Windows. Files are kept on redundant storage at our hosting provider. Drives aren't currently backed up separately, so keep your own copies of anything you can't afford to lose.
- Accounting software: a license to use the software for your business for as long as you pay for it, with updates, under the license terms shown when you install it.
We may improve or change how a service works. We won't remove something you're paying for without at least 30 days' notice, and if a change materially reduces a service you can cancel and get a prorated refund for the unused time.
4. Uptime, backups and support
We work hard to keep everything running and we watch it around the clock, but unless a signed agreement sets a service level, we don't guarantee any particular uptime, and there are no service credits. Hosting can be interrupted by maintenance, failures at our providers, attacks, or problems in your own site or app.
Backups are a safety net, not a guarantee: they can fail or be incomplete, and they're kept for a limited time. Keep your own copies of your files and data.
Support is by email (support@securegatetechnologies.com) and support requests in the hub, during business hours (Mon–Fri, 9am–6pm, Pacific time), excluding holidays. We aim to reply within one business day; that's a target, not a promise. Outage alerts go out whenever our monitoring sees a problem.
5. Prices, billing and taxes
- Prices are shown in the store in U.S. dollars. Plans are billed monthly in advance to your card on file, starting when you buy. Virtual drives are priced per GB of the size you choose; changing the size changes the price, prorated.
- Payments are processed by Stripe. Your card details go straight to Stripe and never reach our servers.
- Prices don't include taxes; you're responsible for any sales or similar taxes that apply, which we'll show separately where we must collect them.
- We may change prices with at least 30 days' notice by email; the new price applies from your next billing date after that, and you can cancel before it does.
- If a payment fails, we'll tell you and try again. If it's still unpaid 10 days after our notice, we may pause the service until it's paid. Pausing never deletes your data.
6. Cancelling
You can cancel a card-billed plan at any time in the hub (Billing, Plans). It keeps working until the end of the month you've paid for and then stops; nothing more is charged. Plans we invoice directly are cancelled by sending us a request. Payments for time already used aren't refunded, except where the law requires or where these terms say so.
Before a service ends, you can download your files (over SFTP or your virtual drive) or ask us for an export. After it ends we keep your data for 30 days so you can still ask for it, then delete it; backups that contain it expire on their normal schedule (14 days for hosting backups).
7. Your content and data
You own the files, websites, apps and data you put on our services ("your content"). You give us permission to host, copy, back up, scan and display your content only as needed to provide the services, keep them secure and follow the law.
You're responsible for your content and for having the rights to use it, and for the security of the code you upload. You must follow our Acceptable Use Policy. Don't store payment card numbers, health information or other specially regulated data on our services unless we've signed a separate agreement covering it.
We don't sell your data, use it for advertising, or use it to train AI models. Our Privacy Policy explains how we handle personal information.
8. Security and suspension
We protect the services with measures such as two-factor sign-in, encrypted connections, isolated accounts for each hosted site, a web application firewall, malware scanning and prompt security updates. If we learn of unauthorized access to your data on systems we control, we'll tell you without undue delay and help you respond.
We may suspend part of a service without notice when that's reasonably necessary to stop an immediate security threat, an attack, or illegal use, for example taking a hacked website offline. We'll limit the suspension to what's needed, tell you promptly, and restore it once the problem is resolved. Suspension doesn't delete your data.
9. Our software and the hub
The hub, our software and our tools belong to SecureGate. You may use them to manage your services while you're a customer; don't copy, resell, reverse engineer or try to break their security. If you send us suggestions, we may use them without obligation.
10. Disclaimers
Except for what these terms expressly promise, the services are provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise the services will be uninterrupted or error-free or produce a particular business result.
11. Limits of liability
To the extent the law allows, neither you nor we are liable for lost profits, lost revenue, lost data that could have been restored from your own copies, or indirect, special, incidental, consequential or punitive damages. Each side's total liability for claims about the services is limited to the fees you paid us for the affected service in the 12 months before the event that caused the claim.
These limits don't apply to fraud, willful misconduct, gross negligence, your obligation to pay for services, your responsibility under the next section, or anything that can't legally be limited.
12. Claims about your content
If someone makes a legal claim against us because of your content or your breach of the Acceptable Use Policy, you'll defend us against it and pay the resulting damages and reasonable costs, as long as we tell you promptly and let you control the defense. You don't owe this to the extent the claim is caused by our own breach or misconduct.
13. Ending these terms
You can close your account at any time after cancelling your services. We may end your account or a service for a serious or repeated breach of these terms that isn't fixed within 15 days of our notice, or immediately for illegal activity or a serious breach of the Acceptable Use Policy. When a service ends, the cancelling section above applies to your data.
14. Nevada law and disputes
Nevada law governs these terms, without regard to its conflict-of-laws rules. Before going to court, we'll both try in good faith to resolve a dispute for 30 days after written notice. Any lawsuit must be brought in the Nevada state courts in Washoe County or, where federal courts have jurisdiction, the U.S. District Court for the District of Nevada in Reno. There's no mandatory arbitration and no jury waiver.
15. Changes and contact
We may update these terms. For changes that matter, we'll give you at least 30 days' notice by email or in the hub; continuing to use the services after that means you accept them. If you don't, you can cancel before they take effect. The date at the top shows the latest version.
Questions or legal notices: support@securegatetechnologies.com or (775) 300-4659. Formal notices to us must be in writing by email; we'll confirm receipt.
